Terms of Service

Last updated: 11 October 2026

These Terms of Service ("Terms") are an agreement between you and OpDesk (Pty) Ltd(registration number 2026/648649/07, "OpDesk", "we", "us"). They apply when you create an account or use the OpDesk platform, our website, our messaging services (Telegram and WhatsApp) and the trip-request lead service. If you use OpDesk on behalf of a business, you confirm you are authorised to bind that business to these Terms.

1. The service

OpDesk is a subscription software platform for tourism, safari, shuttle and lodging operators. It includes bookings, scheduling, invoicing, guest communication and related tools. Features depend on the plan you subscribe to. We may improve, change or retire features over time, and will give reasonable notice of changes that materially reduce what you pay for.

2. Your account

  • You must give accurate information and keep it up to date.
  • You are responsible for activity under your account and for keeping your login details secure. Tell us promptly if you suspect unauthorised access.
  • You decide who in your business gets access, and what role they have. You are responsible for your team members' use of OpDesk.

3. Free trial, plans and payment

  • Paid plans may start with a 14-day free trial. If you do not want to continue, cancel before the trial ends and you will not be charged.
  • Subscriptions are billed monthly in advance through PayFast, in the currency shown at checkout. Prices, including any per-seat or addon charges, are shown on our pricing page and on your Billing page.
  • Your subscription renews automatically each month until it is cancelled. If a payment fails, we may suspend the account until the payment is made.
  • We may change prices with at least 30 days' written notice. The new price applies from your next billing date after the notice period.
  • Amounts already paid for a billing period are not refunded, except where the law requires it or we agree otherwise in writing.

4. Cancellation

  • You may cancel your subscription at any time from Settings → Billing.
  • Cancellation requires 30 days' notice (one calendar month). Your cancellation takes effect on the first billing date that falls on or after 30 days from the date you request it. You keep full access, and are billed as normal, until then.
  • After cancellation takes effect, the account is suspended and no further subscription payments are taken.
  • We may suspend or terminate an account for serious or repeated breach of these Terms, for non-payment, or where required by law. Where practical, we will tell you why and give you a chance to fix the problem first.

5. Your data

  • You own the data you put into OpDesk, including your bookings, guests, staff and financial records. You give us the right to host and process it only to provide the service to you.
  • For personal information you enter about guests, staff, or other identifiable people — including field-log locations or routes that may show where a guide, ranger, tracker, or crew member was, or locate a guest or a guest's vehicle — you are the responsible party under POPIA and OpDesk acts as your operator. You are responsible for having a lawful basis to collect and use it, informing the affected people about that use, and obtaining any permissions required by law. Field-log locations may be added using device GPS, a map, or imported tracks; OpDesk does not continuously track devices.
  • How we handle personal information is set out in our Privacy Policy.
  • You can export your records from the platform while your account is active. Ask us if you need help exporting before your account is closed.

6. Acceptable use

You agree not to:

  • use OpDesk for anything unlawful, fraudulent or misleading;
  • attempt to access other customers' data, or to probe, disrupt or overload the platform;
  • send spam, or message people through OpDesk who have not agreed to hear from you;
  • resell or sublicense access to OpDesk without our written agreement; or
  • upload malicious code or material that infringes someone else's rights.

7. Messaging (Telegram and WhatsApp)

  • OpDesk can send booking updates and reminders to guests, staff and drivers through Telegram and WhatsApp. Guests connect on Telegram themselves and can stop messages at any time by sending STOP to the bot.
  • You must only message people who have agreed to receive your messages or who have an existing booking or business relationship with you, and you must follow the rules of the platforms (Telegram's and Meta's terms and policies).
  • Delivery depends on third-party services. We do not guarantee that every message will be delivered or read.

8. Trip-request leads

  • Travellers who fill in a "Plan my trip" form on our listing sites may have their request shared with qualifying OpDesk operators. Operators on eligible paid plans can see an anonymised summary and may claim a request. The traveller's contact details are released only after a claim, and a request can be claimed by up to three operators.
  • OpDesk charges no commission on leads. Any agreement, quote or booking is strictly between you and the traveller.
  • You must use traveller contact details only to respond to that request, and must respect the traveller's privacy. We do not guarantee that a lead will result in a booking, and we may remove an operator from the leads service for misuse.
  • Access to the Telegram leads group may be limited to operators on qualifying paid plans, and removed when a subscription is cancelled, downgraded or suspended.

9. Availability and support

We work to keep OpDesk available and secure, but we do not promise uninterrupted or error-free service. We may carry out maintenance, and the platform relies on third parties such as hosting, payment and messaging providers whose outages are outside our control. Support is available through the in-app support page or at central@opdesk.app.

10. Intellectual property

OpDesk, its software, design and branding belong to OpDesk (Pty) Ltd. While your subscription is active you get a limited, non-exclusive, non-transferable right to use the platform for your own business. You keep all rights in your own content, logos and data.

11. Liability

  • OpDesk is a tool that helps you run your business. You remain responsible for your operations, bookings, safety, licences, compliance and dealings with your guests and staff.
  • To the extent the law allows, we are not liable for indirect or consequential loss, or for lost profits or bookings, arising from your use of OpDesk.
  • To the extent the law allows, our total liability to you for any claim is limited to the subscription fees you paid us in the 12 months before the event that gave rise to the claim.
  • Nothing in these Terms limits liability that cannot be limited by law, including your rights under the Consumer Protection Act where it applies.

12. Changes to these Terms

We may update these Terms. We will change the "last updated" date and, for material changes, notify account holders by email at least 30 days before they take effect. If you keep using OpDesk after the change takes effect, you accept the updated Terms. If you do not agree, you may cancel as described in section 4.

13. Governing law and contact

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute. We will first try to resolve any dispute in good faith.
